1. Acceptance of Terms

Welcome to Relivit. These Terms of Service ("Terms") govern your access to and use of the Relivit mobile application and related services (collectively, the "Service") provided by Relivit ("we," "us," or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Relivit is a mobile application that uses artificial intelligence technology to animate still photographs, creating lifelike video animations of faces in photos. The Service allows users to:

• Upload photographs containing faces
• Generate animated videos from those photographs
• Download and share the resulting animations
• Store animations locally on their devices

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 years old, you must have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

Some features of the Service may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Upload photos of individuals without their consent or the consent of their legal guardian
• Create animations intended to deceive, defraud, or mislead others
• Create deepfakes or manipulated media for malicious purposes
• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Upload content depicting minors in any inappropriate context
• Use animations to impersonate others or create false endorsements
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Attempt to reverse engineer, decompile, or disassemble the Service
• Use automated systems or bots to access the Service
• Interfere with or disrupt the Service or servers

6. Content Ownership and Rights

Your Content

You retain all ownership rights to the photographs you upload to the Service ("Your Content"). By uploading photos to the Service, you grant us a limited, non-exclusive, royalty-free license to process Your Content solely for the purpose of providing the Service to you.

Generated Animations

The animations generated by the Service from Your Content are owned by you. You may use, download, share, and distribute these animations as you see fit, subject to these Terms and applicable laws.

Our Intellectual Property

The Service, including its technology, software, design, and branding, is owned by Relivit and protected by intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or other brand features.

7. Subscriptions and Payments

Credit System

The Service operates on a credit-based system. Credits are required to create animations and can be obtained through subscriptions or one-time purchases.

Subscriptions

• Subscriptions automatically renew unless canceled before the end of the current billing period
• You can manage and cancel your subscription through your device's app store settings
• Unused credits from a subscription period do not roll over to the next period

One-Time Purchases

Credits purchased as one-time packs do not expire and remain in your account until used.

Refunds

All purchases are processed through Apple App Store or Google Play Store. Refund requests must be made through the respective platform in accordance with their refund policies. We do not directly process refunds.

Price Changes

We reserve the right to change our pricing at any time. Price changes for subscriptions will take effect at the next billing cycle after notice is provided.

8. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you agree to our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted or error-free
• The results obtained from the Service will be accurate or reliable
• The quality of animations will meet your expectations
• Any errors in the Service will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RELIVIT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Relivit and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any content you upload to the Service

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease
• Any unused credits will be forfeited
• We may delete your account and associated data

You may terminate your account at any time by deleting the app and contacting us to request account deletion.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Relivit operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of that jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Relivit regarding the Service and supersede any prior agreements.
